Terms of Use — AI Calorie Counter & Deficit

These Terms of Use (“Terms”) govern your use of the AI Calorie Counter & Deficit mobile application (“App”, “we”, “our”, or “us”). By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use the App.

1. Eligibility

You must be at least 13 years old to use the App.

If you are under 18 years of age, you should use the App only with the involvement of a parent, guardian, or another responsible adult and, where appropriate, after consulting a qualified healthcare professional.

By using the App, you represent and warrant that you satisfy these eligibility requirements.

2. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial use, subject to these Terms and Apple’s App Store Terms and Conditions.

You may not:

  • Copy, reproduce, modify, distribute, sell, sublicense, rent, lease, or commercially exploit the App.
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
  • Use the App for any unlawful or unauthorized purpose.

3. Health Disclaimer

The App is a self-tracking wellness tool intended solely for informational and educational purposes.

The App does not provide medical advice, diagnosis, treatment, or professional healthcare services.

Calorie estimates, calorie deficit calculations, nutrition information, BMI calculations, body measurements, weight projections, meal insights, AI-generated recommendations, and all other information displayed within the App are estimates based on:

  • Information you provide;
  • Public nutrition databases;
  • Published formulas;
  • Artificial intelligence technologies; and
  • Third-party services.

These estimates may be inaccurate, incomplete, outdated, or unsuitable for your individual circumstances.

AI Disclaimer

The App uses artificial intelligence to analyze food images, estimate calories, identify foods, estimate serving sizes, generate nutrition values, and provide meal insights.

AI-generated results:

  • May incorrectly identify foods;
  • May incorrectly estimate serving sizes;
  • May provide inaccurate calorie or nutrition information;
  • May omit ingredients;
  • May produce inaccurate or incomplete recommendations.

You are solely responsible for reviewing and verifying all AI-generated information before relying on it.

The App should never be used as the sole basis for making medical, dietary, nutrition, fitness, or health decisions.

No Guaranteed Results

We do not guarantee:

  • Weight loss;
  • Fat loss;
  • Improved fitness;
  • Improved health;
  • Body composition changes;
  • Achievement of calorie goals; or
  • Any specific health outcome.

Individual results vary significantly.

Barcode Disclaimer

Nutrition information obtained from barcode databases may occasionally be incomplete, inaccurate, outdated, or unavailable.

Users should always verify food packaging labels whenever nutritional accuracy is important.

Food Database Disclaimer

Food names, nutrition values, ingredients, serving sizes, and calorie information are obtained from third-party food databases and AI technologies. While we strive to provide useful information, we cannot guarantee the accuracy, completeness, or availability of this data.

Medical Device Disclaimer

This App is not a medical device.

It is not intended for the diagnosis, prevention, monitoring, prediction, treatment, or alleviation of any disease or medical condition.

Professional Advice

Always consult a licensed physician, registered dietitian, qualified nutrition professional, or other healthcare provider before making significant changes to your diet, exercise routine, calorie intake, fasting schedule, or weight-management plan.

Never disregard professional medical advice or delay seeking medical treatment because of information displayed in the App.

If you:

  • Have diabetes;
  • Have cardiovascular disease;
  • Have kidney disease;
  • Have an eating disorder;
  • Are pregnant;
  • Are breastfeeding;
  • Are taking prescription medication; or
  • Have any other medical condition,

consult your healthcare provider before using the App.

Medical Emergency

Do not use this App during a medical emergency.

If you believe you are experiencing a medical emergency, immediately contact your local emergency services or healthcare provider.

4. Your Data

Your diary, food log, calorie history, goals, body measurements, and settings are primarily stored locally on your device unless otherwise stated.

Certain optional features send limited information to third-party services, including:

  • Food search queries;
  • Scanned barcodes;
  • Meal photos;
  • AI analysis requests.

These requests are processed only to provide the requested functionality.

You are responsible for ensuring that the information you enter into the App is accurate.

Deleting the App generally removes locally stored data that has not been backed up elsewhere.

5. Third-Party Services

The App depends on third-party providers for certain features, including:

  • Food databases;
  • Nutrition databases;
  • Barcode databases;
  • Artificial intelligence services;
  • Cloud services;
  • Analytics;
  • Crash reporting.

We do not own or control these services.

Accordingly, we do not guarantee their availability, accuracy, completeness, reliability, or continued operation.

Features that depend on third-party services require an internet connection and may be modified, suspended, or discontinued without notice.

6. Purchases and Subscriptions

The App is currently free to download and use.

If optional premium features become available in the future, they may be offered as auto-renewable subscriptions through Apple’s In-App Purchase system.

Payment will be charged to your Apple ID upon confirmation of purchase.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

Subscriptions may be managed or cancelled in your Apple Account Settings.

Deleting the App does not cancel an active subscription.

All payments are processed by Apple.

7. Acceptable Use

You agree not to:

  • Violate applicable laws or regulations;
  • Interfere with or disrupt the operation of the App;
  • Attempt to gain unauthorized access to systems or services;
  • Abuse APIs or third-party services;
  • Perform excessive automated requests;
  • Extract data at scale; or
  • Use the App to develop competing products or services.

8. Intellectual Property

The App, including its software, design, graphics, logos, icons, trademarks, text, databases, and other content, is owned by us or our licensors and is protected by applicable intellectual property laws.

These Terms do not grant you ownership of any intellectual property rights.

9. Disclaimer of Warranties

The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied.

To the fullest extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, security, and non-infringement.

Your use of the App is entirely at your own risk.

10. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of, or inability to use, the App.

This includes, but is not limited to:

  • Loss of data;
  • Inaccurate AI-generated results;
  • Inaccurate nutrition information;
  • Food database inaccuracies;
  • Third-party service failures;
  • Health outcomes;
  • Lost profits; or
  • Business interruption.

Our total liability shall not exceed the amount paid by you for the App during the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot legally be excluded or limits your statutory consumer rights.

11. Apple-Specific Terms

These Terms are entered into between you and us only, and not with Apple Inc.

Apple is not responsible for:

  • Maintenance or support of the App;
  • Product liability claims;
  • Legal compliance claims;
  • Intellectual property claims; or
  • Any other claims relating to the App.

If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any).

Except for this limited refund obligation, Apple has no other warranty obligations regarding the App.

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.

12. Termination

We may suspend or terminate your access to the App if you violate these Terms.

You may stop using the App at any time by uninstalling it.

Sections relating to intellectual property, disclaimers, limitation of liability, governing law, and Apple-specific provisions will survive termination.

13. Changes to These Terms

We may update these Terms from time to time.

Material changes will be reflected by updating the Last Updated date above and, where appropriate, by providing notice within the App.

Continued use of the App after any changes become effective constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law principles.

If you are a consumer in a jurisdiction whose laws provide mandatory consumer protections, those protections remain unaffected.
